The requirements for a court marriage in Pakistan depend on the parties’ religion, age, identity, marital status, place of marriage and whether either party is an overseas Pakistani or foreign national. This page is a practical checklist rather than a substitute for case-specific legal advice.
Both parties must enter the marriage voluntarily. A lawyer should not proceed where there is evidence of coercion, fraud, incapacity or uncertainty about consent.
The minimum marriage age is governed by the law applicable to the place and parties. Current rules should be verified before solemnisation. In Islamabad Capital Territory and Punjab, the current minimum age is 18 for both parties.
Commonly required documents include CNIC, NICOP or passport. Foreign nationals may also need visa/entry evidence or other identity verification.
If either party was previously married, the legal end of that marriage should be documented. Depending on the case this may include a divorce decree, Talaq documentation, dissolution order or death certificate of a former spouse.
The applicable marriage law determines witness and solemnisation requirements. For Muslim Nikah, proper consent, mahr, witnesses and Nikah documentation are central. Other religions follow their own legal and religious framework.
The marriage should be registered through the competent authority so the parties can obtain documentary evidence of the marriage. Registration requirements vary by marriage type and location.
Where a party lives abroad, additional documents may include a power of attorney, marital-status certificate, affidavit, certified translation, consular document or attestation. Whether representation is permitted depends on the applicable procedure.
Some couples use the term “court marriage” because they fear family opposition. A marriage and a protection case are separate matters. Where there is a genuine threat, lawyers may advise on appropriate legal remedies, but unnecessary court proceedings should not be presented as a standard marriage step.
